Summary
1.
The NILGOSC Equality
Scheme sets out a commitment to expose the procurement of goods and services to
an equality impact assessment. This
document is the draft impact assessment.

Finance and Personnel guidance. No
differential/adverse impact has been identified on any of the nine groups
specified in Section 75 of the Northern Ireland Act 1998.

6. NILGOSC will take account of the feedback from the
consultation exercise before changing its procedures in the light of the impact
assessment. Once the consultation

will include summaries of the comments received and how they affected the procedures
involved.

1.
Introduction
1.1
In April 2000 the
Northern Ireland Local Government Officers’ Superannuation Committee (NILGOSC)
published its Equality Scheme. In the
Scheme it set out its commitment to expose the investment of contributions and matters
relating to the procurement of goods and services to an equality impact
assessment in 2003.
1.2
This document assesses
the impact of the procurement of goods and services on the nine groups
specified in Section 75 of the Northern Ireland Act 1998 with which NILGOSC is
committed to have due regard to the need to promote equality of
opportunity. These groups are:

Persons of different
religious belief, political opinion, racial group, age, marital status or
sexual orientation
§
Men and women generally
§
Persons with a
disability and persons without
§
Persons with dependants
and persons without.
In addition, without prejudice to the above
obligation, public authorities must also, in carrying out their functions
relating to Northern Ireland, have regard to the desirability of promoting good
relations between persons of different religious belief, political opinion or
racial group.
2.
What is NILGOSC?
2.1
NILGOSC is the pension
scheme for the employees of over 200 public sector organisations in Northern
Ireland including the 26 councils, the non-teaching staff of schools, colleges,
education and library boards and the University of Ulster, the Northern Ireland
Housing Executive, Translink, and many housing associations.
2.2
NILGOSC is managed by a
Committee appointed by the Department of the Environment. The Department also make the pension scheme
legislation. The staff of NILGOSC
undertake the administration of the Scheme rules as a service to the employers
in the Scheme. Each employer in the
Scheme is also responsible for complying with the Scheme rules.
3.
The Policies Under Review
§
Purchasing Policy (May
2003)
3.1
NILGOSC purchases in
excess of £5million per annum in goods and services in line with its Purchasing
Policy. The policy is designed to be
open and transparent with consideration given to best value for money and
quality.
3.2
This impact assessment
will examine how NILGOSC implements the policy, concentrating on the areas
where discretion is exercised.
4.
The Purchasing Policy
A
copy of the policy is attached as an appendix (appendix A) to this document,
the key points are summarised below:
4.1
Openness of Policy
The
policy is designed to demonstrate its openness, transparency and equality, with
due consideration given to quality and value for money.
4.2
Ethical Standards
The
policy requires staff who influence or undertake purchasing of goods and
services to uphold the highest ethical standards, it stipulates acceptable
standards and possible outcomes should the policy be breached.
4.3
Selection of
Suppliers
Criteria
regarding the selection of suppliers is defined within the policy, including:
§
Purchasing thresholds
(for example goods and services between value of £500 - £1,000 requires at
least 3 competitive prices unless part of a call-off or preferred supplier
contract).
§
Written quotations must
be received (and retained) for goods and services valuing between £1,001 and
£15,000.
§
Invitation to tender for
goods and services costing £15,001 or more.
This is made by way of public notice to invite suppliers to express an
interest, then, by using appropriate criteria, a letter is sent to the short
listed responses to give details of the requirements and to invite
tenders. For goods and services
exceeding the value of £144,456 invitations for tender will be advertised in the
Official Journal of the European Union and the appropriate local/national
press.
§
Special arrangements
such as Preferred Supplier, Call Contract or Framework Arrangement may also be
put in place (usually for 3 or 5 years).
Also, being a non-departmental public body, NILGOSC has the option of
using the Procurement Service available.
4.4
Documentation
Unless
in circumstances where payment is made in advance, purchase order forms must be
used for the purchase of goods and services – these are controlled by the
Finance Section and authorised by the Deputy Secretary or Secretary. Invoices are crossed checked against
purchase orders and delivery documentation prior to payments being made.
4.5
Property
Purchasing in relation to building maintenance and repair work will be carried out by the relevant property agent/manager in line with the NILGOSC processes.
In
the case of legal and other professional services connected with the
acquisition of property investment, quotations will be obtained and selected by
the property adviser or the architect (when appropriate).
4.6
Staff Travel and
Subsistence
The use of private cars on approved Committee business is reimbursed in accordance with the mileage rates agreed annually by the NJC. Claims must be made via an Account of Travelling and Subsistence expense form and supported by receipts.
Travel
arrangements can be made either by using a travel agent or by independent
means. Staff are asked to ensure that
value for money is obtained (for example, airport and/or accommodation
reasonably close to destination, economy tickets purchased when appropriate)
and approval has been obtained prior to purchase.
5.
Consideration of Available Data and Research
The following data was used in undertaking the impact
assessment:

details of those who have responded to an Invitation to Tender
6.
Assessment of Impacts
6.1
NILGOSC does not hold information
on any of the 9 groups specified in Section 75 of the NI Act in relation to its
suppliers or in relation to those organisations who have provided
quotations. It therefore has no
quantitative data to show adverse impact on any one group.
NILGOSC does not intend to source such data from suppliers since the information attainable would not be sufficient to ascertain if adverse impact exists among the 9 categories. Information available would:
§
in all probability only
relate to the make up of staff and reflect only 2 of the 9 groups specified in
the Act (gender and religious belief).
§
not reflect how that
supplier carries out its business, ie would not demonstrate if they employed
discriminatory practices.
6.2
Selection of suppliers
has been carried out in accordance to the Purchasing Policy and where
discretion is used to select suppliers the principles of best value for money
are applied, meaning that criteria such as gender, religious belief, disability
etc are not factors in the decision making process.
6.3
Only in circumstances
where a supplier works on an individual basis could NILGOSC make assumptions in
relation to any of the 9 groups. Such
information would be purely speculative and could not therefore be used as part
of this impact assessment. NILGOSC does
not intend to ask these suppliers to provide the relevant information as they
only represent a small percentage (less than 3%) and therefore would not be a
suitable representative sample of the overall supplier list. Any such suppliers have been selected as per
point 6.2 above.
6.4
NILGOSC has also
undertaken a review of organisations that have provided quotations for
provision of goods and services and also those that have responded to an
Invitation to Tender. Suppliers chosen
from each exercise were selected on the basis of offering best value for
money. There was no evidence to or data
to suggest adverse impact on any one group.
6.5
NILGOSC has never
received a complaint based on failure to provide equal access in relation to
the procurement of goods and services by reason of any of the 9 groups and has
no evidence to show any adverse impact.
6.6
Having considered the
current supplier list and reviewed the process for receipt of quotations and
tenders NILGOSC do not believe there has been any direct or indirect adverse
impact on any of the 9 groups specified in the Act.
7.
Consideration of Alternatives or methods of
mitigation
7.1
The current NILGOSC
process regarding Invitation to Tender requires the responding persons to
complete a Fair Employment Declaration (see example in Appendix C).
During
this impact assessment NILGOSC identified a further safeguard that could be
implemented to ensure future adverse impacts do not arise when discretion is
used to select suppliers (ie when Invitation to Tender it is not a
requirement). The Purchasing Policy
lays down ethical standards to mitigate against adverse impact and factors such
as political opinion, race etc are not relevant to the decision making process. However, to ensure that NILGOSC do not deal
with an ‘unqualified person’ (as defined by the Fair Employment and Treatment
(NI) Order 1988, Sections 62 (1), 64-66) and to ensure such a person does not
benefit from the procurement of goods and services with NILGOSC, the NILGOSC
Purchasing Policy will be amended to stipulate that any supplier (current or
future) complete a Fair Employment Declaration.
8.
Formal Consultation
8.1
This impact assessment
is subject to a formal consultation exercise.
Consultees will include those individuals and organisations listed in
Appendix D of the Committee’s Equality Scheme
and amended by experience.
8.2
The formal consultation
exercise will end on 31st May 2004 thereby allowing 12 weeks for
comments to be received.
Many consultees have already indicated how they would like to be consulted, the majority preferring questionnaires or written letter. For those consultees who have not indicated a preference, relevant methods outlined in section 4 of the Committee’s Equality Scheme will be made available. These are:

9.
Policy Decision Following Consultation
Exercise
9.1
This impact assessment
is a review of policies and procedures which are already in operation. The impact assessment has highlighted the
need to change these procedures, however no action will be taken to amend the
existing policies and procedures until the consultation exercise is complete in
order that comments received can be taken into account.
10.
Publication of Results
10.1
NILGOSC will publish by
the most appropriate method to those listed in Appendix D and any other
organisation representing some or all of the stakeholders, the outcome of this
equality impact assessment and any monitoring undertaken.
10.2
This material will also

Purchasing Policy
1. Introduction
1.1 NILGOSC’s purchasing policy is designed to demonstrate
openness, transparency and equality, with due consideration given to quality
and value for money.
1.2 This document sets out the methods to be used for purchasing
of goods and services of varying values and types. It also details the
responsibilities of the Committee, senior management and those involved in
purchasing as regards the maintaining of ethical standards.
2.1
Misuse or misappropriation of the assets and funds of
NILGOSC is a serious matter, which could ultimately lead to criminal
proceedings. Committee members and staff who influence or undertake purchasing
of goods and services must uphold the highest ethical standards. In particular
they :-
§
must, in all their actions, comply with the letter
and spirit of legal requirements to NILGOSC.
§
must not use his/her position to obtain personal gain
from those doing business or seeking to do business with NILGOSC.
§
must not accept gifts or other personal rewards, of
other than token or nominal value, from persons doing or seeking to do business
with NILGOSC. Any gift extended to
influence business transactions with NILGOSC should be refused.
§
may only accept hospitality provided it is modest and
reasonably related to the proper conduct of business. Hospitality of a kind calculated to subject the recipient to
illicit obligations must always be refused.
§
must not undertake commitments or involvements that
give rise to a conflict of interest between fulfilling responsibilities to
NILGOSC and fulfilling responsibilities arising from such other commitment or
involvement.
§
should seek advice from the Deputy
Secretary/Secretary if they consider that there is an actual or potential
conflict of interest arising from existing or prospective commitments or
involvement. He/she should formally declare any source of potentially
conflicting interest in a register kept for that purpose by the Deputy
Secretary/Secretary.
§
Must register their or their immediate relative
involvement as follows: -

Acting as
director or employee of any organisation providing goods or services for reward
to the NILGOSC,

Investing
substantially in, or receiving benefits directly or indirectly from any
organisation actually or potentially engaged in the supply of goods or services

3.2 Purchasing
Officer
3.2.1 NILGOSC
has introduced a ‘Purchasing Officer’ within the organisation, who is a member
of staff nominated by the Deputy Secretary. The Purchasing Officer will be
solely responsible for the placing of orders and completion of purchase orders
and from time to time may authorize members of staff to deal with the tendering
of orders and gathering of quotations.
3.2.2 The
Purchasing Officer will follow professional guidance produced by HM Treasury’s
Central Unit on Procurement (CUP) and ensure that NILGOSC follows best
practice.
3.3.1 Goods and services must be purchased using
only the approved, serially numbered purchase order forms, which are controlled
by the Finance Section and authorised by the Deputy Secretary / Secretary.
3.3.2 In instances where a supplier will provide
goods without receipt of a purchase order, for example goods ordered by
telephone, a purchase order should be completed, nevertheless, as a record of
the indebtedness of NILGOSC to that supplier. If payment is made in advance no
purchase order is required.
3.3.3 The purchase order consists of three copies.
The purpose and distribution of these copies is indicated in Table 1 below.

the goods detailed on the purchase order have been received the goods

ensure correct goods and quantities have been received. Once
the delivery has been ascertained as being correct or any problem associated
with it has been resolved, the pink copy of the purchase order should be
placed with the delivery documentation until the invoice is received. |

This
copy is used to keep a record of the transaction in the purchase order book. |
3.4.1 Upon
receipt of the invoice, it is matched with the delivery document (if received)
and pink copy of the purchase order. Details must be checked to ensure that
quantities received and prices charged are as stated on the purchase order and
on delivery documentation. Any discrepancies should be investigated and, where
necessary, credit notes obtained.
3.4.2 Only
when satisfied that the details are correct should the invoice be approved for
payment by the finance section. If no goods received note was dispatched with
the goods this should be noted on the pink copy of the purchase order with a
view as to whether this is reasonable. The Deputy Secretary / Secretary must
authorize the invoice (accompanied with delivery documentation and pink copy of
the purchase order), before payment can be made.
3.5.1 Anyone willing to provide goods and services
with a monetary value of between £1,001 and £15,000 must supply NILGOSC with a
written competitive quote that must be valid for at least 30 days. The Purchasing Officer must obtain three or
four such quotes depending on the value of the purchase before choosing one
representing best value.
3.5.2 All the quotes received must be filed and
kept for future reference.
3.5.3 In instances where a number of competitive
prices or quotations were requested but only a limited number were received a
explanation should be recorded if it is not possible to obtain the required
number.
3.6.1 From time to time it may be
necessary for NILGOSC to invite tenders for the provision of some goods and
services costing £15,001 or more. An
invitation of Expression of Interest will be made by way of public notice. From
those who respond, using an appropriate criteria, a short list will be
compiled. This stage may be excluded if a short list already exists.
3.6.2 A letter will be sent out
to those on the short list, with details of the goods/services that are
required. The letter also details the requirements of those providing the
service and the closing date at which the tender should be sent to NILGOSC.
3.6.3 The Tenders received will be kept sealed until such time that the
Purchasing Officer can open them in the presence of the Secretary and/or Deputy
Secretary.
3.6.4 On opening a summary will be made of the supplier, the date of receipt,
price of goods/services offers and the main elements of the goods/services
offered.
3.6.4 The Purchasing Officer will
recommend to the Secretary/Deputy Secretary the tender which best meets the
agreed pre-determined criteria.
3.6.5 Any tender in excess of
£100,000 will be referred by the Secretary to the Committee for approval.
3.6.6 The successful and
unsuccessful tenders will be notified in writing.
3.7.1 There
are special arrangements that can be made between NILGOSC and suppliers. They can be Call Contract, Preferred
Supplier or Framework Arrangement. (See
Appendix1). These type of contracts are put in place for a number of years
(usually 3 or 5) and reviewed after this time. This existence of such a
contract may not preclude a separate purchasing exercise outside of an existing
contract if deemed appropriate.
4.1.2 Minor
Repair Work within NILGOSC offices is carried out with the advice of the
Property Managing Agent (Lisney).
Suppliers of minor repair work are sought in-line with the standard
purchasing regulations as and when required.
4.2.1 In the case of legal and other professional
services, in connection with the initial acquisition of property investment,
quotations are obtained from three competent firms in the disciplines required.
4.2.2 The firms invited to quote for legal services
would be selected by the Property Adviser, and in the case of other
professional services, the architect.
4.2.3 The select
list will take account of: -
The staff resources of the firm being asked to quote
Experience of the firm in similar projects
Adequate Professional Indemnity
Cover.
4.3 Major Works for Investment Purposes
4.3.1 The
following table sets out how Architects, Managing Agents and Contractors are selected. The appointment of Mechanical and Electrical
Services, Engineers, Quantity Surveyors, Planning Supervisors and other
services follow the same procedure as for contractors.

5. Travel and Subsistence
Costs
5.1 The use of a private car on Committee
business is reimbursed in accordance with the mileage rates agreed annually by
the NJC. Committee staff or members reclaiming such costs must complete an Account
of Travelling and Subsistence expense form. This is authorised by the Secretary
or Deputy Secretary and is checked to ensure the mileage and rate claimed is
reasonable and that the journey took place.
5.2 Committee staff using their own car for
Committee business must ensure that the vehicle is insured for business use.
5.3 An authorised signatory
cannot sign his/her own expense form.
5.4 The Account of Travelling and Subsistence
expense form can be used to reimburse expenditure outlayed by an individual
from their own pocket on behalf of the Committee. Authorisation by the
signatory confirms that the expenditure was required wholly for NILGOSC
business and that the amount of expenditure was valid. Receipts should be
provided for all such expenditure. If a receipt is unavailable a note must be
made as to the reason why it could not be attached, and the expenditure must
only be reimbursed if the cause for non-receipt is reasonable bearing in mind
the materiality of the amount.
5.5 The Committee will pay subsistence
allowances for meals when away from the office on business at rates as advised
by the Department of the Environment. No receipts are necessary if these
allowances are claimed.
5.6 Purchase of Travel and Accommodation
5.6.1 Travel arrangements can either be made
through a travel agent, and invoiced to NILGOSC or by the individual and
reclaimed on presentation of the necessary receipts
5.6.2 It is the responsibility of the authorised
signatories (Secretary/Deputy Secretary) to ensure that value for money is
obtained. Therefore any person organising travel must seek approval of the
signatory before making the purchase.
5.6.3 Flights should be arranged that suit the
needs of the purpose of travel, ie arrive at an airport reasonably close to the
destination and at times that facilitate attendance at the meeting. Economy
class should normally be booked unless the features provided by a business
class ticket are required (for example business is to be conducted during
travel or a flexible ticket is required). After these considerations are made
the cheapest ticket should be purchased.
5.6.4 Accommodation should be booked at a rate as
close as possible to the subsistence rate but if this is not possible common
sense prevails and a reasonable graded hotel in close proximity to the location
of the meeting offering appropriate facilities is booked.
Appendix 1
Types
of Existing Contracts
Call-off
Contract - Contracts are arrangements, which have
been prepared after a competition has been held under the NILGOSC quotation or
tender procedures and are binding to the organisation. They can be for specific ‘one-off’
purchases, or for goods and services used throughout the organisation for a
fixed period. Examples include purchase
of office equipment or the provision of maintenance for printers or computers
and property insurance etc.
Preferred
Supplier –
A preferred supplier is one where the Purchasing Officer has negotiated
preferential terms from a supplier.
Terms are often in the form of a percentage discount off the suppliers
trade catalogue or price list. The
value of orders to preferred suppliers should, normally, not exceed the
threshold at which NILGOSC’S competitive procedures apply. This type of arrangement is used in, for
example, the supply of the stationery items and Committee catering.
Framework
Arrangement
– A framework arrangement is a form of contract where more than one supplier is
awarded the organisation’s business.
Under framework arrangements, no guarantee is given as to the value or
volume of business that will be placed with any individual firms. During the contract period, the Purchasing
Officer has the choice of which of the contracted suppliers to place his/her
business with. Examples may include the
supply of paper where suppliers may be extremely low and urgent replenishment
is needed, this may also include the supply of personnel computers where the
business may be divided between several suppliers.
As
an Executive Agency within the Department of Finance and Personnel (Northern
Ireland), the Procurement Service provides a professional, fully inclusive
procurement service to an increasing number of public sector organisations.
The
core business of the Service is to establish on behalf of customers effective
contracts for the procurement of goods and services and provide advice and
